Richard Fleck CBE

Richard Fleck is Herbert Smith's Global Relationship Partner, with broad responsibilities for the development of the firm's international practice. His wide-ranging corporate practice embraces competition and regulation, insolvency, dispute resolution and accountancy work. Richard has been involved in many high-profile transactions and disputes.
Richard is a member of the Financial Reporting Council, is the Chairman of the Auditing Practices Board. He was closely involved in the development and drafting of the Smith Report on Audit Committees (now part of the Combined Code). He has acted as an inspector appointed by The Bank of England under the Banking Act 1986 and was responsible for the Report on “The responsibilities of Senior Management” published by The Securities and Investments Board.
- transactions for Time Warner, Fortune Brands, Johnson Matthey, Grand Metropolitan, BAT, W. H. Smith, Stagecoach, Virgin and Fosters Brewing Group;
- acted for clients in industry enquiries concerning the supply of beer, recorded music, distribution of films, newspaper distribution, electricity and airport charges;
- represented clients in international commercial disputes such as the collapse of Enron, the DeLorean Motor Car Group, Johnson Matthey Bankers, the Reksten Shipping Group bankruptcy and resulting investigation, the disputes involving Lonrho/House of Fraser , and Nissan UK/Nissan Motor Company Limited , and the settlement of the Lloyd's of London insurance market dispute;
- advised Andersen, PricewaterhouseCoopers , and KPMG on accountancy, audit and liability matters.
In surveys of the General Counsel of Fortune 1000 companies conducted between 2005 and 2009 Richard was identified as one of a very limited number of lawyers who provide outstanding client service.
